Rezist Website Legal Terms, Privacy Policy, California Notice, Cookie Policy, Data Retention, and Health-Data Disclosures

These Terms & Conditions (“Terms”) form a legally binding agreement between you and Mind Over Body Media Group Inc. (“Company,” “Rezist,” “we,” “us,” or “our”) governing your access to and use of the website located at www.reziststress.com, together with all subpages, content, text, graphics, publications, videos, downloads, forms, programs, communications, and related digital services made available through the website (collectively, the “Website”). By accessing or using the Website, you agree to these Terms. If you do not agree, do not access or use the Website.

1.0 Eligibility

You represent and warrant that you are at least 18 years old and legally capable of entering into these Terms. The Website is not intended for use by persons under 18 years of age.

2.0 Informational and Educational Use Only

The content made available through the Website is provided for informational and educational purposes only. The Website and its content are not intended to replace trained health professionals or to serve as medical, mental health, psychiatric, psychological, or other professional advice. Your use of the Website does not create a physician-patient, therapist-patient, counselor-client, fiduciary, or other professional relationship between you and the Company or any Rezist author, staff member, contractor, coach, or representative.

3.0 Medical and Wellness Disclaimer

Rezist is not a medical organization, and neither the Website nor any information, publication, video, movement instruction, coaching description, or other content on the Website constitutes medical advice, diagnosis, treatment, or emergency service.

Before beginning any movement, stretching, somatic, mindfulness, breathing, meditation, or wellness activity referenced on the Website, you should consult with your physician or another qualified licensed healthcare professional regarding appropriateness and safety for your personal situation.

The Website is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

If you are experiencing a medical emergency or mental health crisis, do not rely on the Website. 

4.0 Assumption of Risk

Use of the Website and participation in activities described on the Website may involve risks, including discomfort, falls, strains, aggravation of existing conditions, emotional distress, injury, illness, or more serious complications. You voluntarily assume all known and unknown risks associated with any activities you undertake based on Website content, except to the extent such risks cannot be waived by law.

Human mental and physical responses vary among individuals. No particular result or outcome is promised or guaranteed from use of the Website, Rezist programs, or related content. Any examples, descriptions, or testimonials are illustrative only and are not guarantees of future performance or outcomes.

6.0 Permitted Use of the Website

Subject to these Terms, the Company grants you a limited, personal, non-exclusive, non-transferable, revocable right to access and use the Website for your own lawful, personal, non-commercial use.

You may not use the Website or any Website content for any unlawful purpose or in any manner that infringes the rights of the Company or any third party.

7.0 Prohibited Conduct

You agree not to:

  • copy, reproduce, republish, upload, post, transmit, distribute, scrape, or exploit Website content except as expressly permitted by law or with prior written permission;

  • modify, adapt, translate, reverse engineer, decompile, or create derivative works from the Website or any software used on the Website;

The Company may offer corporate, employer-sponsored, institutional, or other sponsored access to Rezist memberships, programs, or related services. Such arrangements may be governed by separate contracts between the Company and the sponsoring organization.

If your access is provided through an employer or other organization, certain features, eligibility rules, reporting obligations, and duration of access may depend on that separate arrangement.

11.0 Coaching, Scheduling, and Support Requests

The Website may allow users to submit forms to request information, technical support, scheduling, or contact with Rezist staff, including stress-coach-related inquiries. Submission of a request does not guarantee acceptance, scheduling, availability, response time, or any particular service outcome.

Any support, educational, or coaching-related interactions offered through the Website are for general informational and wellness-support purposes only and do not constitute medical treatment, psychotherapy, emergency intervention, legal advice, or any regulated professional service unless expressly stated in a separate written agreement.

12.0 User Submissions

If you submit information through forms, emails, scheduling requests, support requests, surveys, account registration, questionnaires, assessments, or similar communications (“Submissions”), you represent that you have the right to provide that information and that it is accurate and lawful.

You grant the Company a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, process, transmit, and display such Submissions as reasonably necessary to operate the Website, communicate with you, provide requested services, improve the Website, comply with law, and enforce these Terms, subject to the privacy commitments set forth below.

You should not use general Website forms to submit emergency requests or highly sensitive medical information unless the Website expressly requests such information and describes how it will be handled.

13.0 Intellectual Property Rights

All content on the Website, including without limitation text, graphics, logos, trade names, service marks, trademarks, videos, publications, compilations, designs, layout, software, and other proprietary material, is owned by or licensed to Mind Over Body Media Group Inc. and is protected by intellectual property and other laws.

The Website may contain links to third-party websites, services, or resources. Such links are provided for convenience only. The Company does not control and is not responsible for the content, policies, practices, availability, or accuracy of any third-party website or service.

15.0 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ALL CONTENT, MATERIALS, AND SERVICES AVAILABLE THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR THAT THE WEBSITE WILL BE SECURE, ERROR-FREE, OR UNINTERRUPTED.

The Company does not warrant that any Website content is complete, current, accurate, or suitable for any particular purpose, or that use of the Website will produce any particular wellness, health, stress-related, or business outcome.

16.0 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIND OVER BODY MEDIA GROUP INC. AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AUTHORS, COACHES, LICENSORS, AGENTS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE COMPANY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT, IF ANY, YOU PAID TO THE COMPANY FOR WEBSITE-BASED PRODUCTS OR SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

17.0 Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Mind Over Body Media Group Inc. and its affiliates, officers, directors, employees, contractors, licensors, authors, coaches, agents, and representatives from and against any claims, liabilities, damages, judgments, losses, costs, expenses, and reasonable attorneys’ fees arising out of or related to your use of the Website, your violation of these Terms, your violation of law, or your submission of unlawful, infringing, or harmful content or information.

18.0 Termination

The Company may suspend or terminate your access to the Website or any related account, program, or service at any time, with or without notice, if the Company reasonably believes you have violated these Terms, created legal or security risk, or if access must be terminated for operational, legal, or business reasons.

The provisions of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, governing law, dispute resolution, and privacy-related provisions.

19.0 Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent otherwise required by applicable law. Any dispute arising out of or relating to the Website or these Terms shall be brought exclusively in the state or federal courts located in San Diego County, California, unless applicable law requires otherwise.

The Website is not intended to function as a hospital, physician practice, clinical patient portal, emergency service, or telehealth platform. You should not submit emergency, crisis, or urgent medical information through the Website.

We do not sell health-related or wellness-related personal information that you submit through the Website.
